1. Agreement to Terms
By accessing or using bullionfortune.com (the “Site”), placing any order, or creating an account, you (“Customer,” “you,” “your”) agree to be bound by these Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between you and Bullion Fortune LLC, a New Jersey limited liability company (“BullionFortune,” “we,” “us,” “our”).
If you do not agree to these Terms, do not use this Site or place any orders.
We reserve the right to update these Terms at any time. The “Last Updated” date above reflects the most recent revision. Continued use after changes constitutes acceptance.
2. Eligibility
You must be at least 18 years of age and a resident of the United States to purchase from BullionFortune. By placing an order, you represent and warrant that you meet these requirements. We reserve the right to refuse service to any person or entity at our sole discretion.
3. Account Registration
You may browse the Site as a guest, but an account is required to purchase. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password confidential and not share it with any third party

4. Product Listings, Pricing & Availability
All prices are displayed in U.S. dollars and reflect the current spot price plus applicable premium at the time of display. Precious metals prices are volatile and change in real time. Your price is locked at the moment your order is confirmed.
We reserve the right to:
- Correct pricing errors — if an order is placed at an incorrect price due to a technical error, we may cancel the order and issue a full refund
- Limit quantities per customer
- Discontinue any product at any time without notice
- Refuse any order at our sole discretion
Product images are representative. Actual items may vary slightly in appearance while being identical in weight, purity, and specification.
5. Order Confirmation & Price Lock
An order is not confirmed until you receive an email order confirmation from BullionFortune. The price shown in that confirmation is your locked price. Price locks are valid provided payment is received within the following timeframes:
- Credit/debit card: Charged at time of order
- Wire transfer: Must be received within 3 business days
- ACH transfer: Must clear within 5 business days
- Personal/cashier’s check: Must be received within 7 business days
Failure to pay within these windows will result in order cancellation and may trigger a Market Loss Fee (see Section 7).
6. Payment Terms
We accept the following payment methods:
- Credit/debit card (Visa, MasterCard, American Express) via Stripe
- Bank wire transfer (details provided after order confirmation)
- ACH bank transfer (details provided after order confirmation)
- Personal check or cashier’s check (mailed to our address)
Security: Wire and ACH payment instructions are provided only via email after a verified order is placed. BullionFortune will never ask you to send payment to a different account than what is communicated through your confirmed order email. If you receive instructions that differ, contact us immediately — this may indicate fraud.
Third-party payments: We do not accept payments from accounts not matching the registered account holder’s name. Mismatched payments will be returned.
Stripe: By paying by card, you also agree to Stripe’s Terms of Service.
Fraudulent payments: Any chargeback, reversed ACH, or fraudulent payment may result in account suspension, order cancellation, pursuit of the Market Loss Fee, and referral to law enforcement. BullionFortune actively cooperates with law enforcement in fraud investigations.
7. Cancellations & Market Loss Fee
Precious metals prices fluctuate continuously. If you cancel an order after the price lock window, or fail to make timely payment:
- Within 2 hours of placement: Cancellation is free
- After 2 hours: A Market Loss Fee applies. This fee equals the difference between your locked order price and the current market price of the metals at the time of cancellation, if the market has moved against BullionFortune. If spot price has moved in your favor, no fee applies.
The Market Loss Fee compensates BullionFortune for the hedging cost incurred when your order was confirmed. This is standard practice across the bullion industry.
8. Shipping & Fulfillment
- All orders are shipped via FedEx in discreet, unmarked packaging
- Full insurance is included on all shipments
- Free insured shipping on orders of $5,000 or more
- Processing time: 1–3 business days after payment clears
- Estimated delivery: 2–5 business days (varies by location)
- Signature may be required on high-value shipments
- Risk of loss passes to the buyer upon handoff to FedEx
BullionFortune is not responsible for delivery delays caused by FedEx, weather, or other events outside our control. If a shipment is lost or arrives damaged, contact us within 48 hours of the expected delivery date and we will file an insurance claim on your behalf.

9. Returns & Refunds
Returns are accepted within 5 business days of confirmed delivery, subject to the following:
- Items must be in original, unaltered condition in original packaging
- Contact us before returning any item — unauthorized returns may not be accepted
- Return shipping is the customer’s responsibility
- Refunds are issued for the purchase price less original shipping/insurance costs
- Final sale items (marked as such on the product page) are non-returnable
- Refunds are processed within 7–10 business days of receiving the returned item
Market conditions: Because precious metals prices fluctuate, we cannot guarantee that a return will result in a refund equal to current market value. Your refund will equal your original purchase price, less applicable deductions. Visit our FAQ for common questions
10. Sales Tax
- New Jersey: Gold and silver bullion are exempt from NJ sales tax per New Jersey law
- Other states: Tax is calculated at checkout based on your shipping address and applicable state law. Several states exempt bullion from sales tax; others do not. BullionFortune collects and remits sales tax as required
- Tax amounts shown at checkout are final
11. Precious Metals IRA
BullionFortune facilitates Precious Metals IRAs through our partnership with Entrust Group as IRA custodian and Delaware Depository as the approved storage facility.
- IRA account setup, custody, and administration are governed by Entrust Group’s separate agreements
- Storage of IRA metals at Delaware Depository is governed by Delaware Depository’s separate agreements
- BullionFortune is not a registered investment advisor, broker-dealer, or fiduciary. Nothing on this Site constitutes investment advice, tax advice, or a solicitation to buy or sell securities
- IRA-eligible products are clearly marked on the Site; eligibility is determined by IRS regulations
12. Storage Services
Third-party storage through Delaware Depository is subject to their separate terms, fee schedules, and insurance policies. BullionFortune is not liable for any loss, theft, damage, or delay occurring at or attributable to Delaware Depository or any other third-party storage provider.
13. No Investment Advice
Precious metals investing involves risk. Past performance is not indicative of future results. Prices can go up or down. BullionFortune provides product information for educational and transactional purposes only.
BullionFortune is not a registered investment advisor. Nothing on this Site constitutes financial, investment, tax, or legal advice. Always consult a qualified professional before making investment decisions.
14. Intellectual Property
All content on this Site — including but not limited to logos, product descriptions, images, copy, and educational content — is owned by or licensed to Bullion Fortune LLC and protected by US copyright and trademark law. You may not reproduce, distribute, or create derivative works without our prior written consent.
15. User Conduct
You agree not to:
- Use the Site for any unlawful purpose
- Submit false or misleading information
- Attempt unauthorized access to any portion of the Site or our systems
- Interfere with the Site’s operation through malware, bots, or similar means
- Engage in fraudulent transactions or payments
Violation of these terms may result in immediate account termination and legal action.
16. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BULLIONFORTUNE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT PRODUCT DESCRIPTIONS ARE ACCURATE, OR THAT SPOT PRICES ARE CURRENT AT EVERY MOMENT.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULLIONFORTUNE’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE PURCHASE PRICE OF THE SPECIFIC ORDER GIVING RISE TO THE CLAIM. IN NO EVENT SHALL BULLIONFORTUNE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
18. Indemnificatio
You agree to indemnify and hold harmless Bullion Fortune LLC, its co-founders, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your breach of these Terms, or your violation of any third-party rights.
19. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any legal disputes shall be subject to the exclusive jurisdiction of the state or federal courts located in Middlesex County, New Jersey.
20. Dispute Resolution
Before filing any legal claim, you agree to first contact BullionFortune at info@bullionfortune.com and attempt good-faith resolution within 30 days. If unresolved, disputes shall be settled by binding arbitration under the American Arbitration Association rules in New Jersey, except that either party may seek injunctive relief in court for intellectual property or fraud matters. You waive the right to participate in class action lawsuits.
21. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
22. Entire AgreementThese Terms, together with our Privacy Policy, Shipping Policy, and Risk Disclosure, constitute the entire agreement between you and BullionFortune regarding the Site and supersede any prior agreements.
